It refers to the fact that Barristers in private practice have acted for long periods as Attorney General with conspicuous success.

This introduces another question, for I am of opinion that nothing is more prejudicial to the public service than to introduce outside men into an office of such a confidential nature as that of Attorney General. But apart from this, I venture to doubt the "conspicuous success" of the experiments. This does not allude to the personal qualifications of the two gentlemen referred to in the report who have acted as Attorney General, but to the general character of the work which an Attorney General has to do.

5. Taking the Ordinances first: the drafting in this Colony is very far from being up to standard. This is inevitable where one man succeeds another rapidly, and must be specially the case where outside barristers are brought in. Drafting is a science, not to be acquired in a few months, and most of the mistakes in the colonial laws which I have had to criticise have arisen from want of skill, or lack of knowledge of constitutional principles in the draftsman.

I understand that Mr. Fletcher has recently been appointed as assistant draftsman, and I feel sure that in process of time a proper drafting tradition will be created. This will be of assistance to the Attorney General, because it will relieve him from the mere drudgery of the work; and it will give him more leisure to consider the substantive questions involved in the legislation in hand. It will however not affect the question of his leisure to undertake private practice.
